1 Nature of Service
The Provider operates as a relay and conduit for encrypted VPN traffic on the DeVpn network. In this capacity, the Provider does not originate, select, or modify any traffic that passes through their node. The Provider's role is limited to the transmission of data packets between network participants. This function is analogous to that of an internet service provider or telecommunications carrier, which merely facilitates the passage of information without exercising editorial control over its content.
2 No Logging
The Provider agrees not to log, inspect, store, or modify any traffic passing through their node. This includes, but is not limited to, packet contents, destination addresses, browsing activity, DNS queries, and connection metadata. The Provider shall not deploy any deep packet inspection tools, traffic analysis software, or monitoring systems on their node. Violation of this provision constitutes a material breach of this Agreement and grounds for immediate termination.
3 Session Records
DeVpn maintains session records that link authenticated users to specific connections and timestamps. These records enable DeVpn to identify the originating user responsible for any specific activity routed through the network. DeVpn will cooperate with valid legal requests, including subpoenas, court orders, and lawful government inquiries, to provide information necessary to identify users responsible for unlawful activity. This mechanism ensures accountability while preserving the Provider's role as a neutral conduit.
4 Liability
The Provider acknowledges that they are operating an exit node on the DeVpn network and understands that traffic originating from other users will exit through their internet connection. As a result, the Provider's IP address may appear in connection logs maintained by third-party services.
DeVpn provides legal protections to Providers under applicable frameworks, including Section 230 of the Communications Decency Act (United States) and the E-Commerce Directive (European Union), which generally shield intermediaries from liability for content they merely transmit. However, DeVpn cannot guarantee complete immunity from legal action in all jurisdictions. Providers operating in regions with restrictive internet laws are advised to seek independent legal counsel before participating in the network.
5 ISP Compliance
The Provider is solely responsible for ensuring that their participation in the DeVpn network complies with the terms of service of their Internet Service Provider (ISP). Some ISPs may prohibit the operation of VPN exit nodes, servers, or high-bandwidth relay services on residential or commercial connections. The Provider should review their ISP agreement and, if necessary, contact their ISP to confirm that operating a relay node does not violate their contract. DeVpn shall not be held liable for any consequences arising from the Provider's breach of their ISP agreement.
6 DMCA Response Template
If you receive a DMCA notice or abuse complaint related to traffic passing through your node, you may use the following template to respond. This template asserts your status as a conduit and directs the inquiring party to DeVpn for further investigation.
I am operating a DeVpn relay node. I do not control, monitor, or log the traffic that passes through my connection. I am acting as a conduit under Section 230 of the Communications Decency Act. The content in question did not originate from me. Please direct inquiries to DeVpn at support@devpn.org, who maintains session records that can identify the originating user.
7 Termination
Either party may terminate this Agreement at any time, for any reason, without prior notice. The Provider may shut down their node and cease participation in the DeVpn network at their sole discretion. DeVpn reserves the right to revoke the Provider's access to the network, disable their node credentials, and remove them from the active relay pool. Upon termination, all obligations under this Agreement cease, except for any provisions that by their nature survive termination, including liability limitations and indemnification clauses.
